Official artwork. The registry of problematic housing projects does not reflect the true picture of shareholder fraud

The unified register of problematic housing construction projects does not provide a complete picture of defrauded shareholders, explained real estate lawyer Denis Butovichev. commenting Report of the NSN portal by the governor of the Moscow Region, Andrei Vorobyov the head of state about the decision There are problems in the region with deceived participants in joint construction.

“The unified register of problematic objects really shows that today there are no problematic objects in the Moscow region. If you look at the register, then the governor said everything correctly. However, the problematic objects may be outside the registry. More than ten years of experience of the shareholder protection company shows that not all problematic objects are included in it. There are several formal criteria, namely: bankruptcy of the developer, six months delay in delivery of apartments, six months delay in putting the house into operation. Not all problematic properties may meet these criteria. In addition, in order to be included in the register of problematic properties, there must be applications from the shareholders themselves,” explained Butovichev.

At the same time, the lawyer listed several objects near Moscow that are not included in the unified register of problematic objects. “There are real estates with overdue transfers in the Moscow region, they can be found at the United Developer Resource. This resource, for example, provides information on significant changes to the construction period; “Residential complex Riga Hills” (developer “NW Residential Complex Yarkiy. Riga”), “Residential complex Vostochny-2,3” (Holding Stroypromavtomatika), “Residential complex Troitskaya Sloboda “(“Berendey”), “Residential complex Minipolis 8 kki” “(GC Novard”), “Residential complex Domodedovo Park new district” (“GC Grad”), “Residential complex Skolkovo ONE”, “Residential complex. Dom Chkalov” (both “Ikon Development”), “Residential Complex Malinovo” (“GK Hephaestus”), “Residential Complex Sholokhovo” and “Residential Complex Yuzhnoye Pushkino” (both “RosEuroCity”). Although the information on the Unified Developer Resource may not be accurate, it gives a general idea of the problem,” the expert added.

“The most important problem related to new buildings is the moratorium, according to which developers are not charged a penalty for late transfer of apartments. In addition, low-quality properties with deviations from building norms are handed over. These are individual problems. In addition, the developer often appoints its own (controlled) management company, and it inflates the tariffs to the extent that it even represents certain Internet providers and does not allow them to work with normal tariffs. There are also problems with social infrastructure: either it is not built at all, or it is delivered with a long delay,” Butovichev summarized.
